Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of malpie.com (the "Site") and the growth-planning service offered through it (the "Service"), provided by Luka Tegeltija, a sole trader based in Belgrade, Serbia ("Malpie", "we", "us").

By using the Site, submitting the apply form, or purchasing the Service, you agree to these Terms. If you do not agree, do not use the Site or the Service.

2. What the Service is

Malpie produces a custom 90-day growth plan for a single business, based on a review of that business's website, niche, and publicly available data. A typical engagement involves:

• You submit the apply form with your email and website URL.
• We review your business and respond by email, usually within 1–2 business days, with either a fit assessment or a proposal.
• If you choose to engage us, you pay for the Service via LemonSqueezy (see Section 5).
• We deliver the growth plan and any agreed deliverables within the timeline communicated to you at the time of purchase.

Malpie does not offer a self-serve product, a user account, or ongoing subscription access. The Service is a one-time professional deliverable.

3. Who can use the Service

You must be at least 18 years old and legally able to enter into a contract to purchase the Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Your responsibilities

To get value out of the Service, you agree to:

• Provide accurate information about your business, website, and goals
• Respond to follow-up questions in a reasonable timeframe so we can deliver the plan as scoped
• Not submit applications containing illegal, infringing, misleading, or harmful content
• Not attempt to disrupt, reverse-engineer, scrape, or overburden the Site
• Not resell, sublicense, or redistribute the deliverables we produce for you without our written consent

5. Payment

The Service is paid as a one-time fee. The exact price is communicated to you in writing before you pay. Payments are processed by LemonSqueezy, which acts as the merchant of record and handles applicable sales tax / VAT.

By completing a payment you confirm you are authorized to use the payment method and that the information you provided is accurate. We begin work on the Service once payment has been confirmed.

Refunds, if applicable, are handled in accordance with our Refund Policy.

6. Deliverables and ownership

Once you have paid in full, you own the specific growth plan that we deliver to you and may use it for the business it was prepared for. You may not resell or publish it as your own work.

We retain ownership of all underlying frameworks, templates, checklists, research methods, and the Site itself, including their copyrights and trademarks. Nothing in these Terms transfers those rights to you.

7. No guarantee of business results

Malpie provides strategic recommendations based on our professional judgment, your inputs, and publicly available data. We do not guarantee any specific business outcome — including traffic, rankings, revenue, signups, or growth — because those outcomes depend on factors outside our control (execution, market conditions, competitor behavior, third-party platforms, and more). The Service is advisory, not a performance commitment.

8. Third-party tools

Growth plans may recommend third-party tools, platforms, or services. We are not responsible for those third parties, their pricing, their availability, or any harm they cause. Your use of any recommended tool is governed by that tool's own terms and privacy policy.

9. Availability of the Site

We aim to keep the Site available, but we don't guarantee uninterrupted access. The Site may be unavailable due to maintenance, third-party outages, or circumstances outside our control.

10. Disclaimer

The Site and the Service are provided "as is" and "as available", without warranties of any kind, either express or implied, to the maximum extent permitted by law. Nothing on the Site is legal, financial, or tax advice.

11. Limitation of liability

To the maximum extent permitted by applicable law, Malpie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or in connection with the Site or the Service.

Our total aggregate liability for all claims relating to the Service shall not exceed the total amount you actually paid to Malpie for the Service in the twelve (12) months preceding the event giving rise to the claim.

12. Termination

We may decline to work with you, or stop providing the Service, if you breach these Terms, behave abusively, or if continuing would expose us to legal or reputational risk. Where the Service has not yet been delivered, we will refund any unearned portion of the fee. Where the Service has already been delivered, no refund is due unless required by law or our Refund Policy.

13. Changes to the Terms

We may update these Terms from time to time. The latest version will always be posted on this page with an updated "Last Updated" date. Your continued use of the Site or the Service after a change constitutes acceptance of the revised Terms.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Belgrade, Serbia, unless mandatory consumer protection rules in your country of residence provide otherwise.

15. Entire agreement

These Terms, together with our Privacy Policy and Refund Policy, form the entire agreement between you and Malpie regarding your use of the Site and the Service.
